These terms apply to the use of this website and to wholesale supply from Muna Chuna & Company, Erf 522, 491 James Crescent, Ext 56, Midrand, Gauteng, 1682. By using the website, you agree to these terms.
1. Who we are
Muna Chuna & Company supplies grocery products and general goods to businesses on a wholesale basis. We trade from Midrand and serve commercial buyers such as retailers, independent stores, hospitality operators, caterers and traders.
2. This website is informational, not online checkout
Product listings, pack sizes and descriptions are published so trade buyers can review the range. They are not an offer to sell at a fixed public price. This website has no forms, shopping cart, online payment or automatic order confirmation. Pricing is given by phone or email. A contract is formed only when we issue a quotation and you accept it in writing, or when we accept an order on terms we confirm.
3. Quotations and prices
Prices are given on request and may change with supplier costs, pack availability and delivery location. Unless we say otherwise in writing, a quotation is valid for the period stated on it and excludes value-added tax. Wholesale pricing is intended for business purchasers buying in trade quantities, not for household retail shopping.
4. Orders
An order should identify the goods, pack size, quantity, delivery address and any special handling notes. We may decline an order, limit quantities, or offer an alternative pack where stock or supplier supply requires it. Minimum order quantities may apply.
5. Payment
Payment terms are as stated on the quotation or invoice. Until credit terms are agreed in writing, we may require payment before dispatch. Title in the goods remains with Muna Chuna & Company until we receive full payment. Risk passes to the buyer on collection or, if we arrange delivery, when the goods are handed to the carrier or delivered to the stated address, whichever we confirm on the paperwork.
6. Delivery and collection
Delivery dates are estimates. Delay caused by traffic, weather, supplier shortage or events outside our reasonable control does not give an automatic right to cancel. The buyer must provide a suitable receiving point and someone authorised to sign for the goods. Shortages or visible damage must be noted on the delivery document at the time of receipt and reported to us without delay.
7. Quality and food goods
Grocery products should be stored and used in line with the packaging and ordinary trade practice. We do not accept returns of opened food, chilled or frozen goods, or goods that have been stored incorrectly, except where South African consumer or food law requires otherwise. If goods are defective on arrival, we may replace them, credit them, or refund the price of the affected line after inspection. Our liability for any supply is limited to the invoice value of the goods concerned.
8. Website content
We take care with product names, pack sizes and descriptions. Images are illustrative of the product type. Pack artwork, exact brand mix and available sizes can vary. If a listing is wrong, the quotation and invoice prevail. The website may be updated without notice.
9. Intellectual property
The Muna Chuna & Company name, mark and website design belong to us. You may not copy the site for commercial use without permission. Third-party brand names that appear in the trade, if any, remain the property of their owners.
10. Acceptable use
You may not attempt to disrupt the website or use it for anything other than reviewing our range and contacting us as a trade buyer. We may ignore calls or emails that are abusive, automated or unrelated to wholesale supply.
11. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, including loss of profit, stock-out at a third-party store, or loss arising from a delay we could not reasonably avoid. Nothing in these terms limits liability for death, personal injury or fraud, or any right that cannot be excluded under South African law.
12. Privacy
Personal information you give us by phone, email or in person is handled as described in our Privacy Policy. This website has no forms that collect personal information.
13. Governing law
These terms are governed by the law of the Republic of South Africa. The courts of Gauteng have jurisdiction, without limiting any mandatory consumer protection that applies to you.
